GATHERING EVIDENCE FOR A CONSTRUCTION CLAIM

 

1. Determine Costs to Repair  New home construction claims usually do not involve claims for physical or mental injury.   The primary claims are financial or pecuniary; what did defendant do wrong and how much will it cost to fix it. In evaluating legal claims, an estimate is essential.  A $3,000 problem may be best handled by the homeowner pro se in small claims court; larger claims may merit a lawyer. 

2. Assemble and summarize documentation.  Keep letters, preliminary  agreements, etc.

3. Take photographs Get photographs, videotapes, or other items to explain the nature of a problem.

4.  Research common problems If others have similar problems, they will undermine a defense  that you contributed to the problem or the condition is normal.
